CIVIL MEDIATION

Our core service is neutral third party mediation, with counsel and their clients, prior to trial. Experienced mediators work with you and your clients to learn the facts of your case, understand your needs and interests, and help you communicate that to the other side. Following an initial conversation with both sides, the mediator convenes a 4-way meeting to identify and explore options for settlement.

In some cases, counsel or clients identify a need for further production of documents before they can consider settlement. The mediator will work with the parties to develop a schedule for the exchange of documents and a date for continuing the mediation. If settlement is near, the mediation can be concluded via conference call.

Individuals often contact us directly when they are involved in a dispute with another person or company. You may find it helpful to try mediation before initiating a legal proceeding because the other person is likely to be more co-operative. You don't give up any of your legal rights by trying to resolve an issue at mediation. You can always consult a lawyer for advice at in point during mediation.

What if you want to mediate and the other side says 'No'? Or you are afraid to tell them that there is a problem. We may be able to help to get the other side to the table or to resolve issues that will improve their readiness for mediation. If the other party will not agree to mediation, we coach you to develop alternative strategies.
